Judge Maryellen Noreika sided with the prosecution on Friday, setting the stage for the trial, tentatively slated for early June. Hunter Biden's legal team heavily relied on their assertion that an immunity clause in their defunct plea deal was validated upon mutual signing. However, Noreika emphasized that the agreement necessitated probation officer approval, which was never obtained. Noreika dismissed this claim, highlighting that the charging decision occurred under the current administration, overseen by Hunter Biden's father.

Noreika dismissed the defendant's assertion as absurd, stating, 'Defendant's claim is effectively that his own father targeted him for being his son, a claim that is nonsensical under the facts here.' This ruling adds to a series of legal setbacks for Hunter Biden. Earlier this month, a federal judge in California thwarted similar challenges to a nine-count indictment on tax charges. With the Delaware gun case moving forward, the tax case is anticipated to proceed to trial just weeks later.
